Despite the high number of bills in Parliament, serial amendments on the laws could have a negative impact on investor confidence. Analysts say incessant changes to laws could be a pointer that quality of debate and depth of discussions that went into discussing bills.

This could also be a pointer to the fact that most of the bills were not subjected to comprehensively interrogation by specialists and researchers before heading to the House for discussions.

“Some of these amendments are unprofessional because while they should ensure they cover as much as possible before passage, MPs realise a few weeks later laws need amendments,” said Sterling Capital Investment director John Kirimi, adding that MPs should look at various scenarios deeply before passing bills.

“Adequate consultations are lacking, making it difficult for the country to actualise these bills without changes. This is the reason why there are so many annual amendments to bills,” says Francis Kamau of Ernst and Young.

Changes in policies could affect investors’ confidence as they shy off on account of unpredictability of polices governing business. An example is the Companies (Amendment) Bill 2017 which is being changed after changes were made a few months ago.

“The law on gaming has also changed more than seven times in the last six years which could affect investors in the sector,” said Kamau, adding that it impacts on the ease of doing business in the country because what investors want is stability in their operations.
